2. Purpose

This Legal Notice governs access to, navigation of, and use of the Website by any person who accesses it (hereinafter, the User).

This Legal Notice does not regulate the engagement or provision of the services offered by IberianTax, including but not limited to: tax management and filing services for non-residents, certificate and registry processing, administrative procedures related to real estate, and other services offered through the Website. Such services are governed by their respective General Terms and, where applicable, Particular Terms, which will be made available to the User during the contracting process and must be expressly accepted before the service is formalised.

3. Access conditions and acceptance

Access to the Website and the creation of a user account are free of charge, without prejudice to the fact that certain services offered through the platform may require the payment of a fee and shall be governed by their respective General Terms of Engagement and, where applicable, the particular terms that apply.

The use of the Website implies the knowledge and acceptance of this Legal Notice and of any other applicable legal texts.

Likewise, the creation of a user account implies the express acceptance of these conditions and of the policies published on the Website from the moment the User completes the registration process.

If the User does not agree with these provisions, they must refrain from using the Website and, in particular, from engaging the services offered through it.

4. Conditions of use of the Site

4.1. General principles

The User undertakes to use the Website in accordance with applicable law, this Legal Notice, good faith, good practices, and public order, refraining from using it for unlawful purposes or in any way that may cause damage, interruptions, overload, or alterations to the operation of the Website or to the equipment, systems, or services of IberianTax or of third parties.

In particular, the User undertakes to refrain from the following conduct:

  • (b) Attempting to gain unauthorised access to the Site, to the servers on which it is hosted, or to any server, computer, or database connected to the Site.
  • (c) Using bots, scrapers, data-extraction software, robots, scripts, or any other similar process to access, copy, collect, transmit, or monitor the pages, data, content, or Services available on the Site.
  • (d) Manipulating or using IberianTax’s corporate identification — including logos, trademarks, domain names, or email addresses — to conceal or alter the origin or content of messages sent in connection with the Services, or for any purpose not expressly authorised.
  • (e) Engaging in defamatory, threatening, harassing, or offensive conduct towards the personnel, agents, collaborators, or representatives of IberianTax, or towards other Users of the Site.
  • (f) Reproducing, distributing, transforming, or commercially exploiting the contents of the Website without express authorisation.
  • (g) Accessing restricted areas without authorisation, using false identities or third-party data without legitimacy, or impersonating the Owner, its personnel, clients, or third parties.
  • (h) Using the Website to send unsolicited advertising or commercial communications, or for purposes that harm the rights of the Owner or third parties.

4.3. Truthfulness of information and third-party data

All information provided by the User through the Website (forms, registrations, interactive tools) must be truthful, accurate, and up-to-date. The User shall be solely responsible for any damages arising from false or inaccurate statements.

The User undertakes to cooperate with any authentication measures that may be necessary and to confirm their identity or any information provided when IberianTax reasonably requests it, in order to guarantee the security and proper provision of the Service.

Where the User provides personal data of third parties (co-owners, spouses, representatives, end clients in B2B relationships, etc.), they guarantee that they have sufficient legitimacy and have previously informed the third party of the matters required by applicable regulations, holding the Owner harmless against any claim arising from the breach of this obligation.

4.4. Consequences of non-compliance

Failure by the User to comply with the obligations set out in this section shall entitle IberianTax to adopt, depending on the seriousness of the breach, the following measures: require the User to immediately cease the infringing conduct; temporarily suspend the User’s access to the Site or to the Services; take whatever legal action is appropriate, including claims for damages and losses.

5. Free Tools and Resources

5.1. Nature

The Website may offer the User, free of charge, tools such as calculators (Modelo 210 and similar), simulators, templates, downloadable guides, informational articles, ebooks, and other educational resources (hereinafter, the “Free Resources”). The Free Resources are provided for educational, informational, and indicative purposes only.

5.2. Estimative nature and limitations

The results generated by the calculators and simulators are estimative and indicative in nature. They do not constitute and do not replace a tax self-assessment, a final tax amount, professional advice, or a personalised calculation.

The User expressly acknowledges that: (i) the results depend entirely on the truthfulness and accuracy of the data the User enters; (ii) the tools may not account for all variables, exemptions, deductions, special regimes, territorial particularities, or personal circumstances applicable to their case; (iii) tax regulations and administrative criteria may change or be subject to new interpretation; and (iv) the actual result, once effectively submitted to the competent authority, may differ from the estimated one, without this giving rise to any liability on the part of the Owner.

The use of the Free Resources does not constitute the provision of a professional service or a contractual relationship with the Owner, nor does it replace the engagement of the corresponding service — which includes, depending on the case, additional validation, review by the Owner’s team, actual submission to the competent authorities, and specific support.

5.3. Downloadable materials

Downloadable materials (guides, ebooks, templates, infographics) are made available to the User for personal and informational use only. The User may download and keep them for their own use but must refrain from reproducing, distributing, transforming, or exploiting them without express authorisation, and from altering or removing any notices of ownership, copyright, or update date contained in the materials.

5.4. Personal data and modification of the Resources

Where the use of a Free Resource involves the processing of personal data (for example, providing an email to download a resource or to receive the result of a calculation), such processing shall be carried out in accordance with the Privacy Policy. The Owner reserves the right to modify, suspend, or withdraw the Free Resources at any time and without prior notice, without this generating any liability.

6. Nature of the published information and disclaimer

In general, all information, contents, guides, blog articles, examples, calculators, frequently asked questions, and other educational materials published on the Site are exclusively informational and indicative in nature. Such information refers to general scenarios without taking into account the particular circumstances of the User or Taxpayer, and does not constitute tax, legal, or professional advice of any kind.

IberianTax makes reasonable efforts to ensure that the published information is accurate and up to date in accordance with current regulations, but does not guarantee its completeness, currency, or applicability to specific cases. The User is responsible for verifying such information and, where deemed necessary, consulting a qualified tax advisor or professional regarding their particular situation.

Access to the Website, the reading of its contents, the downloading of materials, the use of contact forms or interactive tools, and the subscription to communications do not imply the existence of a professional, contractual, or individualised advisory relationship between the User and the Owner. Any service provided by the Owner shall be governed exclusively by the General Terms and Particular Terms accepted during the engagement process.

Any decision made by the User on the basis of the information published on the Website is the User’s sole responsibility.

7. Intellectual and Industrial Property

All contents of the Website — including distinctive signs, texts, articles, guides, images, software, source code, calculation algorithms, calculators, simulators, databases, interfaces, designs, functionalities, and other constituent elements (hereinafter, the “Contents”) — are owned by the Owner or by third parties who have authorised their use.

Any use of the Site or the Services in breach of this section shall entitle IberianTax to suspend the User’s access, terminate the contract, and take any legal action it deems appropriate to defend its rights.

The Website may contain links to third-party websites for purely informational purposes. The Owner does not control the linked content nor guarantee its availability, accuracy, security, or legality. The inclusion of a link does not imply any recommendation, endorsement, or relationship with the linked operators. The User accesses third-party pages at their own risk.

The establishment of links from third-party sites to the Website is subject to the following conditions: (i) it must not create confusion as to the identity or ownership of the Owner, nor falsely suggest a relationship, authorisation, or association; (ii) the total or partial reproduction of the Contents or the use of techniques that alter their original presentation is not permitted; (iii) it may not be carried out from pages containing unlawful, derogatory, discriminatory, or reputation-damaging content for the Owner; (iv) the trademarks, logos, or distinctive signs of the Owner may not be used without prior written authorisation.

The Owner may maintain corporate profiles on social networks and other external channels, which shall be governed by the legal conditions and policies of each platform. The Owner shall not be liable for the actions, contents, data processing, decisions, or changes made by such platforms.

Communications through social networks or external channels are purely informational or for general engagement purposes. For the contracting, management, or provision of services, as well as for sending documentation, personal data, or operational instructions, the User must use only the official channels enabled through the Website.

10. Reviews, testimonials, and opinions

The Website may include customer reviews, testimonials, or ratings, whether owned or from external platforms. Such content reflects individual experiences and does not guarantee identical results for other users, and may depend on specific personal, tax, documentary, or temporal circumstances. The Owner may moderate, withdraw, decline to publish, or request the removal of false, offensive, unlawful, or non-verifiable contents.

11. Fraud and identity impersonation prevention

Unauthorised third parties may use or attempt to use the Owner’s name, trademark, or identity for fraudulent purposes, including phishing or similar techniques, fraudulent websites or emails, false payment instructions, or impersonation of the Owner’s personnel.

The Owner recommends that the User always verify that received communications come from official domains and channels, especially when personal data or payments are requested.

The Owner shall not be liable for communications, payments, instructions, or documents made by third parties impersonating the Owner or using unofficial channels. In case of doubt, the User shall contact the Owner through the official channels before providing any information or making any payment.

12. Disclaimer of warranties and liability

The Owner does not guarantee the total and uninterrupted availability and continuity of the Website. The Owner may temporarily suspend access for reasons of maintenance, security, updating, or force majeure, without this giving rise to any right to compensation.

To the maximum extent permitted by applicable law, the Owner excludes any liability for damages and losses arising from: (i) technical failures, service interruptions, network outages, or incidents attributable to external providers; (ii) improper, negligent, or unlawful use of the Website by the User; and (iii) unauthorised access, cyber-attacks, or security incidents not attributable to a lack of reasonable diligence by the Owner, as well as any other circumstances beyond its control.

The User shall be liable to the Owner and to third parties for any damages, penalties, or claims arising from the breach of this Legal Notice, of applicable regulations, or from the misuse of the Website.

13. Final provisions

13.1. Communications

Communications between IberianTax and the User shall take place primarily by electronic means, including the email address provided by the User at the time of registration and, where applicable, through the user dashboard available on the platform.

The User is responsible for keeping their email address up to date and for periodically reviewing the communications sent through these means. Communications sent by IberianTax shall be deemed validly made from the moment they are sent or made available on the user dashboard, as appropriate.

13.2. Commercial communications

The Owner shall not send commercial communications by electronic means without the recipient’s prior consent, except in the cases legally provided. For Users with a prior contractual relationship, the Owner may send communications about its own products or services that are similar to those previously contracted, offering in each communication the possibility to opt out easily and free of charge.

The User may revoke their consent or object to receiving commercial communications by sending an email to contact@iberiantax.com or by using the mechanisms provided in the communications themselves.

13.3. Language and applicable version

These conditions have been originally drafted in Spanish. Where translations into other languages are provided, such versions shall be for information purposes only. In the event of a discrepancy between versions, the Spanish version shall prevail in any case, unless applicable law provides otherwise in favour of the consumer user.

13.4. Partial invalidity and severability

If any provision of this Legal Notice or of the legal texts linked to it is declared null, invalid, or unenforceable, this circumstance shall not affect the validity of the remaining provisions, which shall remain in full force.

13.5. Modifications

The Owner reserves the right to modify the Website and this Legal Notice at any time, in order to adapt them to legislative, jurisprudential, technical, or organisational developments. The version in force shall be the one published on the Website, with the date of its last update being indicated at the beginning of the document. The User is advised to review it periodically.

14. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law and, where applicable, by the EU regulations that apply.

Where the User has the status of consumer, the disputes arising from this Legal Notice shall be subject to the courts and tribunals competent in accordance with applicable law, the User being entitled to choose those of their domicile, those of the place of performance of the obligation, or any others granted to them by mandatory legislation.

15. Out-of-court dispute resolution

In accordance with the applicable consumer protection law, a User with consumer status may resort to the alternative dispute resolution (ADR) mechanisms in consumer matters that apply in their country of residence.

Likewise, the User may submit any claim directly to IberianTax through the contact details set out in this Legal Notice, with IberianTax committing to acknowledge receipt and to respond in the shortest possible time.
